Official Rules & Prizes
All entries must be received by August 31, 2009. No purchase necessary. A purchase will not increase your chances of winning. Must be a legal U.S. resident, 21 years of age or older to enter. The following sweepstakes is not intended for play in California, Utah and where otherwise restricted by law.
Winner Selection/odds of winning: Drawing will be held on or around September 15, 2009. Only eligible entries actually received by Kona Brewing Co (Sponsor) on or before the deadline of August 31, 2009 are eligible to win. Odds of winning depend upon the total number of eligible entries received. All prizes legitimately claimed will be awarded. Potential winners will be notified via mail, e-mail and/or telephone on or about September 15, 2009. Winners will be required to complete and return an affidavit of eligibility and liability/publicity release within fourteen (14) days of the date of notice is sent or prize will be forfeited and may be awarded to an alternate winner. By accepting a prize, participants grant to Sponsors (Kona Brewing Co.) the use of their name, voice, photograph, likeness, biographical information and address for publicity purposes in all media now known or hereafter discovered, without notice, review, approval or further compensation, except where prohibited by law.
Prizes: Two (2) Grand Prizes: 2 round trip tickets from West Coast gateways to Kona, Hawaii and 5 days and 4 nights lodging (ARV $2,000). Sponsor reserves right to substitute a prize of equal or greater value. Prize not redeemable for cash nor transferable. Except as specifically provided herein, prize package does not include any other items not specifically described in these Official Rules. Limit (1) one prize and entry per person/family/household. Each winner is solely responsible for all applicable taxes on prize.
Eligibility: Employees of Kona Brewing Co., their distributors, advertising and promotional agencies, retailers, and the families of each of the above are not eligible.
General Conditions: It is the entrant's responsibility to ensure compliance with all conditions contained in the Official Rules. Sponsors and affiliates are not responsible for any lost, late, delayed, misdirected, mutilated, garbled, illegible, incorrect or inaccurate information on entries emailed in. As a condition of entering this sweepstakes, participants agree that:
1) under no circumstances will participant be permitted to obtain awards for, and hereby waives all rights to claim punitive, incidental, consequential and any other damages, and any and all rights to have damages multiplied or otherwise increased; 2) any and all disputes, claims and causes of actions arising out of or connected with this sweepstakes, or any prizes awarded, shall be resolved individually, without resort to any form of class action, and exclusively by arbitration; 3) participant shall be bound by these Official Rules.
